Welcome to asgILLUSTRATION. These Terms of Service (“Terms”) govern your use of our website, online store, products, services, subscriptions, and related features, including The Sundry Art Post.

Throughout these Terms, “asgILLUSTRATION,” “we,” “us,” and “our” refer to asgILLUSTRATION. “You” and “your” refer to any visitor, customer, subscriber, or other person using our website or services.

Our store is powered by Shopify, which enables us to provide our online store and related services.

By visiting, interacting with, purchasing from, subscribing to, or otherwise using our website or services, you agree to these Terms and our Privacy Policy. If you do not agree with these Terms or our Privacy Policy, you should not use our services.

1. Access, Accounts & Customer Information

By using our services, you represent that you are legally able to enter into these Terms in your jurisdiction.

When browsing our store, creating an account, subscribing, or making a purchase, you may be asked to provide information including your name, email address, billing information, payment details, and shipping address.

You agree that the information you provide is accurate, current, and complete and that you have the right to provide it.

You are responsible for maintaining the security of any account credentials associated with our website and for activity occurring through your account.

You may not sell, transfer, assign, or license your customer account to another person.

2. Intellectual Property

Unless otherwise stated, all original artwork, illustrations, graphics, designs, logos, photographs, written content, product designs, sticker designs, prints, packaging, mail club materials, website graphics, branding, and other original creative works created by asgILLUSTRATION remain the intellectual property of asgILLUSTRATION.

Where our artwork depicts or is inspired by intellectual property owned by a third party, nothing in these Terms is intended to claim ownership of that third party’s underlying characters, trademarks, or other intellectual property. Our rights apply to the original artistic expression and content created by asgILLUSTRATION to the extent permitted by law.

Purchasing, receiving, downloading, viewing, or otherwise accessing a product or artwork does not transfer copyright, ownership, reproduction rights, licensing rights, or commercial rights to you.

You are purchasing the physical or digital item offered—not the copyright to the artwork contained within it.

Unauthorized Use

Unless you have received express written permission from asgILLUSTRATION, you may not:

  • copy, reproduce, republish, or redistribute our artwork;

  • scan or create downloadable reproductions of our physical products;

  • upload our artwork for others to download or reproduce;

  • sell, license, or commercially distribute our artwork;

  • print our artwork onto merchandise, stationery, apparel, prints, stickers, or other products;

  • use our artwork in advertisements, branding, promotional materials, or business materials;

  • edit, alter, recolor, remix, trace, manipulate, or repurpose our artwork for publication or commercial use;

  • create unauthorized derivative products from our artwork;

  • remove or obscure artist signatures, watermarks, copyright notices, or identifying information;

  • claim our artwork or designs as your own;

  • upload or distribute high-resolution reproductions that would allow another person to reproduce the artwork;

  • use our artwork to create or sell substantially similar reproductions; or

  • use our artwork in any manner that falsely suggests an affiliation, endorsement, collaboration, or partnership with asgILLUSTRATION.

Any reuse, publication, reproduction, licensing, redistribution, or commercial use requires express written consent from asgILLUSTRATION.

3. Artificial Intelligence & Machine Learning

Artwork and other creative content produced by asgILLUSTRATION may not be used for artificial intelligence, machine learning, generative AI, model development, or related technologies without our express written consent.

This includes, but is not limited to, uploading, submitting, scraping, copying, storing, processing, or otherwise supplying our artwork or creative content to:

  • generative AI platforms;

  • AI image generators;

  • machine-learning systems;

  • artificial intelligence training datasets;

  • model-training or model-development datasets;

  • model fine-tuning systems;

  • image-to-image AI tools;

  • style-transfer or style-replication systems;

  • LoRAs;

  • checkpoints;

  • embeddings;

  • datasets or archives intended for AI development; or

  • systems designed to reproduce, imitate, approximate, analyze, or learn our artwork or artistic style.

You may not use asgILLUSTRATION artwork to train, fine-tune, develop, test, benchmark, or improve an artificial intelligence or machine-learning model.

You may not upload our artwork to an AI system for the purpose of generating a recreation, variation, imitation, derivative image, style imitation, or similar content.

You may not scrape or collect our artwork, website images, product images, written content, or other creative materials for inclusion in datasets used for artificial intelligence or machine-learning purposes.

These restrictions apply to personal, educational, research, nonprofit, and commercial uses unless asgILLUSTRATION has provided express written authorization for that specific use.

4. Fan Art & Creative Inspiration

We love seeing genuine artwork inspired by our work.

Certain fan art inspired by original asgILLUSTRATION artwork, characters, concepts, or designs may be shared for personal, noncommercial purposes, provided that the new work is genuinely created by the person sharing it and does not simply reproduce or republish the original artwork.

Where applicable, fan art should clearly identify asgILLUSTRATION as the original artist or source of inspiration.

Appropriate credit should include either:

so that viewers can easily locate the original artist and work.

Fan art may not:

  • be sold or commercially distributed without permission;

  • be used to manufacture merchandise without permission;

  • be presented as official asgILLUSTRATION artwork;

  • substantially copy or trace the original artwork and present the reproduction as a new work;

  • be used for business branding or commercial promotion;

  • suggest an official collaboration, sponsorship, partnership, or endorsement where none exists;

  • intentionally remove or conceal the original source or artist credit; or

  • be created using an artificial intelligence system supplied with or trained on asgILLUSTRATION artwork.

Creating fan art does not transfer ownership of any underlying asgILLUSTRATION artwork, designs, or other intellectual property.

asgILLUSTRATION reserves the right to request removal of fan-created content that infringes our intellectual property, falsely represents our brand, reproduces our work without sufficient transformation, or is commercially exploited without permission.

If you would like to sell fan art, license an illustration, collaborate with us, or use an asgILLUSTRATION work commercially, please contact us for permission first.

5. Sharing Purchases on Social Media

Customers are welcome to photograph products purchased from asgILLUSTRATION or received through The Sundry Art Post and share those photographs on personal social media accounts.

Credit is always appreciated and may be provided by tagging @ashliesg_ or linking to www.asgillustration.com.

Sharing a photograph of your purchase does not grant permission to scan, digitally extract, reproduce, redistribute, sell, or otherwise republish the underlying artwork.

Please do not post high-resolution scans, isolated artwork files, or downloadable reproductions that would allow others to reproduce our products or artwork.

6. Products & Product Representation

We make reasonable efforts to accurately represent our products and services.

However, colors and appearance may vary depending on your device, monitor settings, printing process, paper, materials, lighting, and other factors.

Many asgILLUSTRATION products are artist-produced, handmade, assembled by hand, or created in small batches. Minor variations may occur and are part of the nature of independently produced artwork.

Product descriptions, availability, designs, pricing, and other details may change without notice.

We reserve the right to discontinue a product, limit quantities, or restrict availability where reasonably necessary.

7. The Sundry Art Post

The Sundry Art Post is a recurring art-mail subscription featuring changing artwork, designs, themes, letters, stationery, stickers, prints, and other creative items produced or curated by asgILLUSTRATION.

Themes, artwork, contents, formats, and included items may vary from month to month.

A subscription does not guarantee that every monthly edition will contain the same number, type, style, or format of items.

Billing, renewals, cancellation deadlines, subscription management, and other subscription-specific information are governed by our Subscription Policy.

By subscribing to The Sundry Art Post, you also agree to our Subscription Policy.

8. Orders

When you place an order, you are making an offer to purchase the selected products or services.

asgILLUSTRATION reserves the right to accept, decline, modify, or cancel an order when reasonably necessary.

An order is not considered accepted until payment has been successfully processed and the order has been confirmed.

Please review your order carefully before submitting it. We may not always be able to accommodate cancellation or modification requests after an order has entered processing or production.

We may refuse or cancel an order in situations including:

  • suspected fraud;

  • unauthorized payment activity;

  • incorrect pricing;

  • payment problems;

  • product availability issues;

  • suspected unauthorized commercial resale;

  • abuse of our policies; or

  • other circumstances that reasonably prevent us from fulfilling the order.

If we cancel an order after collecting payment, any applicable refund will be returned to the original payment method.

9. Pricing & Billing

Prices, discounts, promotions, and product availability may change without notice.

The price charged will generally be the price displayed at the time your order is placed.

Unless otherwise stated, displayed prices may not include applicable taxes, shipping charges, customs fees, import charges, or other fees.

Promotional offers may be subject to additional terms. If specific promotional terms conflict with these general Terms, the promotion-specific terms will apply to that promotion.

You agree to provide accurate and current purchase and payment information.

By submitting payment information, you represent that you are authorized to use the payment method provided.

10. Shipping, Delivery & Replacements

Shipping timelines, delivery estimates, lost-mail procedures, replacement eligibility, and related information are governed by our Shipping & Returns Policy and Refund Policy.

Postal delivery estimates are estimates only and are not guaranteed.

Shipping may be affected by carrier delays, weather, holidays, postal processing, customs, incorrect customer-provided addresses, or other circumstances outside of our reasonable control.

Because postal delays do occur, an order will not automatically be considered lost merely because it has not arrived within the carrier’s initial estimated delivery window.

Please refer to our Shipping & Returns Policy for the applicable delivery buffer and procedures for reporting mail that may be lost.

Where an order qualifies as lost or damaged under our policies, a replacement may be offered instead of a refund, as described in our Refund Policy.

11. Returns & Refunds

Returns are not accepted except where otherwise required by applicable law.

Refunds, replacements, damaged orders, missing orders, and undelivered mail are handled according to our Refund Policy and Shipping & Returns Policy.

12. Personal Use & Unauthorized Resale

Unless otherwise stated or approved in writing, asgILLUSTRATION products are sold for personal use.

You may not purchase products primarily for unauthorized commercial resale, reproduction, or manufacturing.

Purchasing a physical product does not grant permission to reproduce the artwork appearing on that product or manufacture additional products using that artwork.

Unauthorized commercial reproduction or distribution is prohibited.

13. Website & Service Use

You may access and use our website and services only for lawful purposes.

You may not use our website or services to:

  • engage in unlawful or fraudulent activity;

  • violate applicable laws or regulations;

  • infringe upon our intellectual property rights or those of another person;

  • impersonate asgILLUSTRATION or another person or entity;

  • falsely imply an affiliation, endorsement, sponsorship, or partnership;

  • transmit viruses, malware, or other harmful code;

  • interfere with the operation, security, accessibility, or functionality of our website;

  • attempt unauthorized access to customer accounts, systems, data, or administrative areas;

  • collect or track another person’s personal information without authorization;

  • reproduce, duplicate, copy, extract, sell, or exploit portions of our website or services without permission;

  • circumvent technical measures intended to restrict access; or

  • use our website in a manner that may harm asgILLUSTRATION, Shopify, our customers, or another person.

We reserve the right to restrict, suspend, or terminate access where we reasonably believe these Terms have been violated.

14. Scraping, Automated Tools & Agents

You may not use robots, spiders, scraping tools, crawlers, automated extraction tools, data-gathering systems, AI agents, or similar automated technologies to access, collect, extract, reproduce, or process content from our website without express permission.

Automated systems may not:

  • circumvent security measures;

  • bypass access restrictions;

  • evade robot-exclusion measures;

  • conceal their automated nature;

  • scrape artwork or product images;

  • collect content for AI or machine-learning datasets; or

  • systematically archive our creative content.

Nothing in this section grants permission to use content that is otherwise protected by our Intellectual Property or Artificial Intelligence provisions.

15. Third-Party Tools & Links

Our website may provide access to third-party tools, websites, integrations, payment processors, subscription platforms, shipping providers, or other services.

We may not control or monitor all third-party services.

Your use of third-party services may be subject to separate terms and privacy policies established by those providers.

We are not responsible for the availability, content, policies, security, products, or actions of independent third-party websites or services.

16. Relationship With Shopify

asgILLUSTRATION is powered by Shopify, which enables us to provide our online store and related services.

However, purchases made through our store are made directly with asgILLUSTRATION.

Shopify is not the seller of asgILLUSTRATION products and is not responsible for the products, artwork, subscriptions, order fulfillment, shipping, replacements, or other aspects of transactions between you and asgILLUSTRATION.

Your use of Shopify-related functionality may also be subject to applicable Shopify terms and policies.

17. Privacy

Personal information collected through our website and services is handled according to our Privacy Policy.

Because our store is hosted by Shopify, Shopify may collect and process certain personal information in connection with your access to and use of the store.

Information you provide may also be shared with service providers where reasonably necessary to process orders, payments, subscriptions, shipping, website functionality, or other services.

18. Reviews, Feedback & Public Posts

If you voluntarily submit a review, testimonial, photograph, or similar content directly to us for publication, or publicly tag or mention asgILLUSTRATION in content relating to our products, you grant us a non-exclusive permission to repost or display that content for purposes such as showcasing customer experiences or promoting our products.

Where reasonably appropriate, we will retain or provide attribution to the original creator.

You represent that content you submit does not violate another person’s copyright, trademark, privacy, publicity, or other rights.

We reserve the right to remove content submitted through our website that is unlawful, abusive, fraudulent, infringing, malicious, or otherwise violates these Terms.

19. Errors, Inaccuracies & Omissions

Occasionally, information on our website may contain typographical errors, inaccuracies, omissions, incorrect pricing, outdated availability information, or other mistakes.

We reserve the right to correct errors, update information, modify product details, or cancel an affected order where reasonably necessary.

We may restrict, suspend, or terminate access to our website or services where we reasonably determine that a person has violated these Terms, abused our services, infringed our intellectual property, engaged in fraudulent activity, or otherwise used our services in an unauthorized manner.

Termination does not eliminate obligations that arose before termination.

Sections relating to intellectual property, artificial intelligence, prohibited uses, liability, indemnification, and other provisions that by their nature should continue will remain in effect following termination.

21. Disclaimer of Warranties

To the fullest extent permitted by applicable law, our website and services are provided on an “as is” and “as available” basis.

While we make reasonable efforts to provide accurate information and reliable services, we do not guarantee that the website will always be uninterrupted, error-free, secure, or available.

Nothing in these Terms limits warranties or consumer protections that cannot legally be excluded.

To the fullest extent permitted by applicable law, asgILLUSTRATION will not be responsible for indirect, incidental, special, punitive, or consequential damages resulting from your use of our website, products, subscriptions, or services.

Nothing in these Terms is intended to exclude or limit liability or consumer rights that cannot legally be excluded.

The remaining provisions will continue in full force and effect.

25. Waiver & Entire Agreement

Our failure to enforce a provision of these Terms does not waive our right to enforce that provision in the future.

These Terms, together with the policies referenced within them, constitute the agreement governing your use of our website and services.
